1. Overview

This website is operated by Urban AU Watches. Throughout the site, the terms “we”, “us” and “our” refer to Urban AU Watches. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

2. Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction.

3. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

4. Products and Pricing

Modifications: Prices for our products are subject to change without notice.
Availability: Certain products may be available exclusively online through the website. These products may have limited quantities and are subject to return or exchange only according to our Return Policy.
Accuracy: We have made every effort to display as accurately as possible the colors and images of our watches. We cannot guarantee that your computer monitor's display of any color will be accurate.

5. Third-Party Tools (Shopify)

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases, and the general Shopify application.

6. Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content:

For any unlawful purpose.
To solicit others to perform or participate in any unlawful acts.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

7. Limitation of Liability

Urban AU Watches does not guarantee that your use of our service will be uninterrupted, timely, secure, or error-free. In no case shall Urban AU Watches, our directors, officers, or employees be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind.

8. Consumer Guarantees (ACL Compliance)

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Major Failure: This is when a reasonable consumer would not have bought the watch if they had known about the problem, or the watch is unsafe/significantly different from the description.
Minor Failure: If the problem is not major, we will (at our discretion) repair the item, replace it, or offer a refund.
Proof of Purchase: You must provide a receipt or other proof of purchase to claim a remedy under the ACL.
